The Courts have very wide powers to protect parties of a relationship or their children from domestic violence and to deal with rights of occupation of the home to include restricting or excluding one party. These orders are commonly termed ‘injunctions'
Orders will generally last for six months although in certain circumstances the Court has power to make the order for an unspecified time.
Where the court makes an order dealing with the occupation of the home it also has power in many cases to make secondary orders dealing with payment of the outgoings on the home, the contents and, arguably, to require one party to pay the other an amount in respect of their occupation.
The Courts also have power to make injunctions in cases of stalking or harassment.
